One that intrigued me involved these facts: A woman passenger, riding in a car driven by her husband, was killed in a multi-vehicle auto collision. Her daughter filed a wrongful death action, naming the husband as a defendant. The husband also filed a wrongful death action but, not surprisingly, did not name himself as a defendant. The trial court dismissed the daughter’s suit. After all, Tennessee law gives priority to the spouse to bring such a suit. Under these unique circumstances, the Court of Appeals reversed. The Tennessee Supreme Court disagreed, based on statutory analysis. It found no exception to the spousal priority rule in our wrongful death statute, even if the spouse is a potential defendant, nor had the surviving spouse waived his right to bring the case. Nelson v. Myres (Tenn., Page, March 5, 2018).
